Ban on Use of DJI, Autel and Other Covered Foreign Drones - State Drone Replacement Program
Starting in 2018, security concerns about data handling and links to servers outside the United States have been a concern that led the Department of Defense to ban the purchase and use of DJI drones due to cyber vulnerabilities.
Beginning December 22, 2025, federal funding cannot be used for the purchase or operation of drones (UAS) that do not comply with federal standards for security. This national restriction—arising from the American Security Drone Act of 2023 and the National Defense Authorization Act of 2024—applies to DJI, Autel, and other UAS brands.
To address these security and privacy concerns, all noncompliant drones used by state agencies (regardless of use) must be replaced with compliant models. The State of North Dakota is launching a Drone Replacement Program (authorized by Senate Bill 2018) to facilitate this process. The program allocates $9 million from the Strategic Investment and Improvements Fund, supporting the replacement of noncompliant drones used by state agencies—including educational institutions overseen by the State Board of Higher Education.
Program Details
- Eligibility: North Dakota state agencies, including educational institutions, that own noncompliant drones acquired before January 1, 2025, qualify for replacements.
- Implementation: The North Dakota Department of Commerce and the Northern Plains UAS Test Site (NPUASTS) will:
- Assess agency requirements
- Recommend compliant UAS
- Provide training for new equipment
- Decommissioning: Noncompliant drones must be properly decommissioned according to federal and state rules.
- Reporting: The Department of Commerce is required to report on the program’s progress to Legislative Management by June 30, 2026.
The NPUASTS is currently gathering information about drones that are to be replaced. They will be developing additional details and a timeline for the replacement program.
